Opening statements today in the trial of a Brevard County teacher accused of being drunk at a Cocoa Beach house party with more than a hundred students in attendance.
Karly Anderson faces charges of disorderly intoxication and resisting an officer. Here's her defense attorney Kenneth Weaver says his client did nothing wrong and was not arrested on the scene.
Weaver says Anderson had been out drinking with the owner of the party house, Elizabeth Hill-Brodigan, the former principal at Roosevelt Elementary School, where Anderson also taught.
Weaver says his client was concerned about the officer putting a student in the back of a police car.
The jury was seated Monday, with many prospective jurors saying they had heard about the case or saw police body-camera video that shows Anderson yelling at first responders after they arrived at scene.
The prosecutor telling the jury that the police-worn camera video shows Anderson was clearly intoxicated.
Her attorney, Kenneth Weaver, admitted his client was drunk. "She has a moment." But he says she was concerned about a child being put in the back of a cop car.
Weaver says yelling at an officer is not illegal and "She does not threaten or touch him."
Weaver had argued that the charges be dropped against his client, the judge declined after viewing the police video.
Anderson has turned down a plea deal and has pleaded not guilty.
She faces up to a year in jail if convicted. The judge expects the trial to be complete by Wednesday.
